FMEP BC violates Separation agreements based on their internal polices, despite their claim they cannot change court order or agreements. FMEP encourages recipients to ignore court orders and conditions of payment, where FMEP supersedes orders and agreements to get the money none the less.

FMEP causes more disputes, disrespects the rights of payors and recipients, changes maintenance levels without court orders and have no over sight, are repressive in their handling of cases. I support fair maintenance to children, but do not support FMEP’s methods to undermine families and encourage recipients to violate orders and agreements promising the money none the less.

I have just been lied to by FMEP or at my case worker this last mth. I have a court order stating that IF I get laid off work the recipient agreed to not pay for 3 mths. This would however need to be paid once I started working again in increments on top of my regular pay. Needless to say FMEP did not oblige the court order ( I did get laid off) I argued this and he said that he would talk to his legal department about the order, he’s got back to me telling me that no , it dosnt stand.
I even called them in good faith to let them know I may be late or not be able to pay in full till I find work again. They garnished my EI anyways. , than fined me $400 dallars . I’ve been paying for 24 years on time every mth unless there has been a situation out of my control , i also pay half of everything for my kids. So is this a fair just system, hell no. I’m still on EI 2mths in and they are littgetting blood from a stone. I hate them. They are ruining my life . I know why some dads just run , I get it , I see why people in this situation kill them selves or the ex. FMEP is a joke with no heart or care for the healthy and well being of another human just trying to be the best he can. I’ll stand behind any man that has done there duty as a payer and gets kicked in then it’s when he just needs a little understanding to his situation.

FMEP will not follow the court order, they will only use the parts that define the amount of money you are to pay and any condition set in the order that changes that they will not follow. This is essentially a violation of the court order since they act in place of the recipient.

The only thing you can do is take it back to court and get the court to fix it and order FMEP to remove the penalty charge and add to the order that FMEP will not disregard any part of the order.
