    ok, so BC maintenance enforcement was enforcing through garnishment the debtor’s paycheck. he moves out of the province to follow work with the same company, and they continue garnishing his dollars. 6 months later, they realize that he is no longer living in the province, and close the file, and return to him the dollars that are still being garnished through the order with his employer. If they are still receiving dollars from him, shouldn’t those dollars be sent along to his child? now BC MEP has put him in arrears which another jurisdiction now has to recover. This program should be a national initiative, not provincial. I guarantee they would recover more dollars if the officers in the various departments could communicate with each other more often than once every 3 months. people move provinces every day. Should someone be able to dodge their commitments by moving? especially when it takes a year for the MEP offices to catch up? Totally ridiculous!

        I think FMEP is a joke. My ex has had permanent income since 2011 when I filed with them. They did nothing for so long that he nows owes $17,000.00
        I feel they have been negligent and have the letters to prove it. Sent in a complaint to my MP but it was answered with how great they were for getting me some money finally.
        I think we should be paid by the government in cases like these when the owed amounts border on ridiculous!

          See I only owe around 1600, but still pay for my kids when I have them, I got behind on payments because of my lay off where I was left with 1200 a month to live off because of them taking money. I soon lost my house and then couldn’t insure my car and because of that lost my job. Lived in my vehicle for two months and only wanted a little bit of time to get on my feet where they wouldn’t allow. I often go without food or my bills get too high to manage. And now, I have a baby on the way, where I’m stable and have it figured out but they take more than what they should be allowed. My court order states that I pay 50 extra towards my arrears not the amount they take. They are going against my rights as a human and if I had it my way, I wouldn’t pay at all since I have my kids a week on and a week off, I pay for half of what they need or do and I don’t claim CTB and I still pay. It’s a bloodletting system, and pathetic. (I’m not saying all parents are the same, I know there are many who don’t care but for the parents who do try shouldn’t get this kind of treatment.)

            FMEP can not garnish more than I think 25% of your paycheque. If the child was still living with you, you would be contributing at least that to their upbringing regardless of you being laid off or not. Morgan, how are the courts going against your human rights by ordering you pay $50 towards your arrears? If you have your child one-week on, one-week off that sounds like 50% child sharing to me in which you would not be obligated to pay child support. Support is only required where the child lives primarily in one home over the other. You may need to go to court to seek a change to your order if that is the case. FMEP can only enforce what has been ordered. And from what I have witnessed, they give plenty of chances for the payer to volunteer payment arrangements before they start garnishing.
            FMEP should absolutely be given more authority over getting some payment when garnishing wages is not available. If the payor claims to not be working, he/she should not be driving. They will not put a drivers license hold if it inhibits the payer’s ability to work. But if they have other options and choose themselves over the child, I believe FMEP should have every right to ensure the child’s needs always come first.

          I totally get it. My ex is a teacher and makes 85k per year. I was laid off my job and made only 17k. FMEP didn’t care and still took 910/mth. Had to sell my apartment and live in my truck with my great dane.

            I’ve had it with these rotten bastards . I’ve been laid off from my job and am getting a big 1300 a month and their taking 25% of that. I can’t pay my bills and had to cancel insurance on my vehicle. They wonder why people want to come through the fu$#ing phone with them when you cant afford food at a bad time

          I agree. I have gone around and around and around for 11 years with ICBC .Everytime im in an accident im left paying for repairs physio, medical expenses ect ect ect out if my disability checks for accidents I never even caused and many times icbc just waists years blowing me off hanging up on me and being rude to me and then they let the claims expire! Im fucken pissed off now. This is not ok!!! How many people must I call. How many law suits complaints and files must i start before something is done!! If I have to I will start a huge class action suit on behalf of other citizens as well as for myself for what we are being put through. I was left suing an injury law firm that was employing ex icbc employs who where having there injured clients executing the release of all there rights by former icbc adjusters with no lawyers or witnesses present and everyone is ok with this. I’ve have contacted Icbc , the ombudsmen of bc, my mla office ,the law society. When is someone going to step in and do something other then all the nothing being done??????? Why are we paying insurance when we are not being insured!!!??? I think I will sue icbc now for breach of contract as everytime I am in an accident or hurt they start there bullshit games. I will now be starting a web page where I will be also posting emails, recorded icbc phone conversations and icbc documents because I will not be silenced or ignored anymore. Im done playing by these corrupt peoples rules. Its time we all cancel our insurance and demand change or we should all get together and start a huge class action law suit against icbc.

        FMEP in BC is run by liars and man haters , I was told by BC FMEP to challenge the arrears of my cases (two children two diff. mothers) so that they could be sorted out once and for all , I agreed and filled out the financial information and got duty council to represent me , I’ve been on disability for many years after suffering a brain aneurysm on the job and was eventually fired witch was ruled as unjust by gov. officials and I received U.I.C. benefits witch were garnisheed by FMEP. I tried to go back to work many times thinking I had to work no matter how bad my epilepsy got or P.T.S.D. witch made me volatile and made holding any job for a length of time impossible at best , I suffered another near fatal seizure and was in another coma for 5 days , I’ve suffered 3 coma’s now . All throughout this miserable confusing time FMEP harassed me , garnisheed me, had me arrested twice for missing court took my Drivers License away and has me owing some ridiculous amount of arrears to the tune of almost $50,000 the bulk of witch all compiled while I’ve been on disability or not working over the last twenty years. Now my health failing and in need of serious dental work FMEP are holding up some pension funds I’ve applied for under the new pension “hardship” rules , it seems my financial advisor works for them and not me as he would have put through my request and had the funds intercepted by FMEP without warning me this would happen if I had not asked him about the chances of this happening ! Tracy Young of the Kamloops FMEP office seemed so nice to me on the phone and I almost fell for it except for that afternoon I received two letters with her signatures on both documents signed only days before by her putting a stop to my application for hardship funds from my pension money .I don’t know where to go with any of this , it was hard enough to concentrate long enough to fill this letter out as my thoughts get scattered and stress takes over for witch I apologize , please help me someone if you can ‘ I’ve been waiting for 4 months for this money and can hardly eat because of my dental issues , I feel I’m one of the people in this society that have no voice or rights because no-one cares about deadbeat dads no matter what the true facts are

          You are right that FMEP are lairs. I have there own document to prove that I was over charge, but they will not repay that excess that they garnashed from me. Today in court (Prince George) they stated that if my motion was won it would set presidence and open the flood gates for more law suits. At the end of it the judge sides with them and dismissed my claim.

            My son overpaid and they won’t go after his ex to get the money back. Yet they went after my son to get money for her. Told my son he’d have to take her to small claims court to get it back. What a joke!

          I agree 100% that fmep are a bunch of liars, I was in arrears for a bit but I have a good job and paid them in full… until today when I received a phone call from fmep asking why I have only been paying 250$ each pay, that’s when the confusion set in because my wages are garnished by fmep! They said I was suppose to pay 350$ each pay lmfao, so I phoned the office and they sent me the letter via email. Which was from fmep stating that my employer takes 250$ so fmep fucked up and put me back In arrears which I still have to pay up… again fml!

I have not seen my kids because i left a abusive relationship from alberta to bc got kiddnapping Lost my kids to him. Because of it all. He gets to lie n No one cares

      I think they are just trying to keep those involved to staying in the country so they can continue to victimize them via the family law systems which legally pick the pockets primarily of the impoverished. fees fines etc all go to the same group of basic entities. the wise will avoid completely and leave the country to a non party country and start a new family that doesn’t place the divorcing parties in a life long financial battle neither can win. when their is no motivation to divorce less divorce occurs and more family stability results

    I recently spoke with FMEP regarding a fine to be imposed on the other party for non compliance of a court order for not remitting tax forms. My order gives FMEP the authority to collect the fine as well but when I called to notify FMEP that the payor did not do as ordered,I was asked very rudely if I reminded the payor to abide by the order. I do not believe it is my job to keep tabs on my ex and it isn’t my job to make sure he abides by the terms of the order. The FMEP rep also said they had no authority to collect the fine and argued with me until I told her that my order states that FMEP is to collect the fine. Then the rep read the order over and changed her tune.
    I have had several issues with FMEP and they are useless and do not do the job that they are paid to do.

      I have had several issues with them as well and they always answer rudely to my phone calls. It seem that it is poorly managed and that our Provincial government should have a acute look into this organisation. A very rude help line that do not help in general!

      Several times the fmep has kept the payments being made by my sons father! Like this month I recieved $4.95 when he paid 205$ they garnish from his wage, and last month I recieved a .05cent payment on a $205 payment garnished! This has been going on the whole time they’ve collected my sons monies! The 1st year they garnished his wage, I still never did recieve those payments and when I asked about it, the man on the phone said I recieved them and he had my signatures on cheques I know for a fact I never recieved because I had just moved and wasn’t even told they had finally started garnishing his wage(by the 1st payment my son was 10yrs old) So that 1st year went by without my knowledge that they had even collected any money on my sons behalf! I found out because I joined Facebook and connected with my sons bio father and he told me!! When you question these people or ask to speak to someone higher up,, your greeted with complete and utter ignorance! It’s disgusting! This cash isn’t mine and it’s not their either! It belongs to my son!!! Please see justice served against these crooks! I want to see them be held criminally responsible for the fraud they’ve committed against my Son!!!!

        FMEP OR AKA Themis Maximus employees are mainly bitter women who have a vengeance against men mainly.
        In my case I have a. Ex wife who refuses to mediate and knows if she kept account open these Natzi’s would ruin my life. I provide daily for my kids one resides me with me full time. I can go on and rant but that is not the main purpose of my post.

        Folks, Themis Maximus is also the company responsible for handling British Columbia Medical Services Accounts as contracted out by the BC government. In my situation enforcement employee Shaleen Singh accessed my medical records without consent to find out I had a body injury as a result of a car accident.
        Singh who is extremely RUDE, UNPROFESSIONAL, UN EDUCATED and speaks to you like she is a superior person.
        Singh illegally placed a garnishee for my claim with the insurance company who were obliged to enforce the order. What’s interesting is she obtained a court order without Notifying me in order to prevent me speaking to the judge.
        Case law Loft V Hall heard by BC Supreme Court master Jenkins states, FMEP has no right to such actions.
        The privacy breach on my medical information is Extremely serious my complaint with the Obmusman is just he beginning I intend to file with the privacy common also.
        I never authorized the BC government to release my personal information.

        I am looking to start a class action lawsuit along with media coverage because of the breach. If anyone is interested to join please let me know. FMEP will be exposed for their unethical methods of ruining people’s life.

          I agree a very large class action must be started. Do you know that the law society of bc thinks its ok for injury law firms to be employed by icbc while representing injured people. Did you know that the law society of bc insures all lawyers and law students in bc so if your lawyer rips u off or wrongs you, you cant even hire a lawyer to help you as they would be suing there own insurance. They are leaving hurt and disabled people fighting law firms in supreme court unrepresented. That in its self is a human rights violation. No one does anything. They play games untill you lose your shit then they treat you like your mental. They give you number after number to call. They tell you to contact your mla contact icbc fairness comitioner, contact ombudsmen but does any one do anything???? NO. Nothing is done nothing at all. I worked my ass off suing the law firm that had an ex ICBC adjuster have me sign away all my medical rights for the accident that left me permanently disabled with no witness or lawyer present while representing me there injured client. SO NOT OK!!!!!!

I have no guarantee that the money is going to my X. I had a pahone call today from FMEP in victoria saying that I could not sue FMEP by law. I’m not so sure. I was also told that if I was to proceed that they would send a lawyer to court and I could end up paying for cost. Also I might have to start my action all over again if it was thrown out of court. So I’m with you.

    My daughter live in the state and my CS is in USD. I recently been informed from DCS (Division of Child Support) in Washington state that the money transfered from FMEP to DCS created an arrear of approx $1400 USD. Every year in June, FMEP send me a letter showing there calculation and new rate to cover my USD child support. The problem is that I never missed one payment and I always paid a little more that what FMEP told me to pay. I would like to know why this is happening and what created this issue. I will be very disapointed in FMEP if I have to pay 1400 USD immediately due to a calculation mistake from them. It is my understanding that there only mendate is to take care of my account and make sure that it is properly handle.

      You will probably need to go over all of your financial statements,receipts , etc and check the conversion calculations and exchange rates on the dates of conversion. An arduous task most certainly. But I don’t believe anyone will do this for you. Once you have your proof I would then approach FMEP about it. If it’s not removed by your EO with the proof you provide then use their complaint process and move up within the organization. If not resolved involve the Director, your MP, MLA. THE OMBUDSMAN WILL NOT LOOK AT IT UNTIL THIS IS DONE AND DOCUMENTED.

        Actually, DCS sent their calculation to FMEP and asked them to return with their calculations. As per FMEP I don’t owe anything yet, it would be a outrageous if I have to pay for their mistake. As far as im concerned, I always paid what FMEp asked me to pay.

    DCS will send a invoice with all calculation to me as well, FMEP said they were looking into it. As far as i’m concerned and based on my experience with FMEP, i beleive that DCS is right unfortunately, this is why I think that FMEP is pointless and should be closed!

      I would say a serious overhaul of the entire program is defiantly needed. We must push for it. In your case I would continue to document all of your dealings with FMEP and give them a reasonable time to respond and then escalate the matter.

        Sorry, I’m not sure if this was a reply to me, I’m Sarah that made the comment last year about not receiving my sons child support payments as they where garnishing from his paychecks! Well it’s only gotten worse! I haven’t received payments in about 6months now! Yet i asked him, and ne told me they still garnish his wage every month, and he pays extra towards the debt, that he has been doing since my son turned 10yrs old and this all caught up with him! I don’t know what to do from here! They’ve*FMEP* have went to town with this court order for my sons child support, yet they don’t give it over to us! They keep these payments! I see it like their borrowing my sons money(with no permission and i have no clue their intent on paying it back!) interest free!! I was never interested in loaning out my sons money in the 1st place! I figure ifni want to see this money, I’ll have to get a good lawyer and take them on in court! I seriously hope they get exposed for the crooks they are!! I’m not impressed with the whole thing! And I’ve NEVER received any reciepts or payment information with thr payments, so I don’t have much proof of the money they did pay, other than the silly 5cent direct deposit on my banking statement! And they just don’t deposit anything anymore!!! I’ve had no luck in talking to them, their so ignorant on the phone and when i send msgs online! It’s not their money, I give no permission for them to just hold or keep anything! It took so many attempts for them to finally accept my direct deposit forms(they kept saying i had to have direct deposit and where holding payments then too, but would send random payments here n there, and now they have my direct deposit forms, i asked why they where keeping the payments and this woman replied saying, where not keeping your payments,, but yes they are!!! And they have sent a few pages that show what he has paid,, when i requested copies of this information, and i know i never received all these payments direct deposit or otherwise!!

          FYI, Family Maintenance Enforcement Program is actually contracted out by the BC government to the private firm Themis Program Consulting Ltd which is owned by an American company, Maximus. They are crooked beyond belief, and our Liberal government and their insider cronies are all players in this corrupt scheme, and judges may also be implicated as well. Missing money stolen from single mothers is a common occurrence with these people who operate with zero culpability but receive in excess of
          $10 million to ‘operate’ this shady program. Google them, you will find more information than you would care to know about them and our corrupt government.

          People are trusting that these sort of companies made of inhuman people will actually have some sort of sympathy in dealing with real people.

          FMEP was put in place for themselves, as someone already mentioned, they do fraudulent activities, and pretty sure a lot of support payments never reaches the other party.

          This is why partners need to get together and work something out on their own for the children. The courts and these enforcement companies do not give a rats ass about the slogan ” In the best interest of the child”. More like their own best interest and their families.

          This needs to be shut down, the family act needs to be redone, and this whole divorce and separation garbage with courts and lawyers needs to stop.

          They enforce the debt, but never enforce seeing your children, so really their company slogan is a farce and designed to deceive the majority into thinking they are doing in “in the best interest of the child”… Bull Shit

    FMEP Is a joke they have far too much power , they told me I had to pay child support for my 20 year old daughter which is fine they have taken money from me The problem is They have failed to prove she is in school They stated well we heard form the debtor she is , yet I have asked for start date and end date and they igmnore me

    My ex-husband stopped paying child support and spousal support on January 31st, 2013. He emailed me at the end of February of that year that he was in a “financial crisis”, and that he was unable to pay, but that he was doing everything in his power to change his circumstances. I enrolled with FMEP and have had a few small payments made since then, however my ex is now in excess of $385,000.00 in arrears, and counting (it will be nearly $$393,000.00 in June). I have had a few communications with the FMEP, asking why interest rates fluctuate so wildly, why they did nothing when he actually HAD a large inheritance sum in the bank, why they now have a ban on issuing him a marine or aviation license (which he holds neither), they’ve only put a hold on any future attempts for him to obtain a Canadian passport (which means he’s likely fine to travel for another 5 years). My ex has admonished me for taking ALL his pension at $182/month, when all my two children receive is $142.00 of that amount (and FMEP cannot explain why or even where the money comes from). They have put a line item in my transactions list that states the government is owed an annual $400 default fee for non-payment, yet it seems to be deducted from the interest payment in that month. Attempts to speak to the FMEP about this have gone nowhere. I believe it’s time to finally expose this system, yet I don’t really know where to start. If this is truly a project to help expose this negligent system, I’d like to participate. Count me in! Oh, and I should mention that my ex STILL drives a BMW, miraculously.

        I would just like every woman out there to know that I have the same sob story. Wah wah wah. I have to take care of my son and my ex wouldn’t help me. Amongst every other thing. What I want to say is “get a job”. How is destroying your ex helping you take care of your kids financially? You are supporting a system that is destroying lives when you should suck it up and support your kids. You obviously already are. Destroying someone’s life is not getting you ahead. So you have his license, and his passport. Good for you and the kids!!! He has no where to live? Yay! That’s exciting news. You are getting richer by the moment. Obviously this is meant for the money hungry women out there and not meant for the civil people of the world so no need to reply if you are going to “educate me” about how wonderful MEP is.

          Thank You Lisa for your contribution and you are dead right. I do not see how destroying someones life is beneficial to anyone, but yet, FMEP do not give a rats ass. As long as these men can be held in perpetual debt, they and the lawyers along with judges use the family courts and all it’s wonderful power (end if a barrel) to keep their own families fed.

          My EX makes TONS of money, while I’m on disability and can barely live. Yeah her cash cows get bigger and she lives high on the hog, while others suffer. This is vindictive and a narcissist way of doing things.

          What judge in their right mind or any common sense, or half a brain would not take facts into consideration to fix certain family issues. Yet they take the word of a lying narcissist as fact, and run with it. I’m still scratching my head hearing the horror stories over a span of 15+ years.

          Men are suffering big time, but yet nobody is willing to take the blame for it or do anything about it. Abolish this stupid ancient thinking and dinosaur way of life and get with the 21st century. Society is going ass backwards, this does not make society flourish. this is going ass backwards.

          Need to do a class action suit to close down the FMEP and hold everyone accountable for their despicable actions. Many men per year commit suicide because of these people, yet they get off scot-free and continue to do damage. We need to sue them for all their wrong doing to society.

    FMEP was to hold all our payments as we are going to court. Every time I called they siad there was an alert and that all payments were being held. Today, they told me that 2 payments went through. They don’t know why but they have held only one. I am so angry, they were to hold all payments. What can we do. The one lady said it was an error

    My case worker Ms. Zimmerman is difficult and is not will to negotiate. Today I negotiated a deal with her boss Helen to get rid of a notice of attachment since I’m not in arrears. I filled out their form and sent it in via the website. She then came back a couple hours later trying to change our deal we discussed on the phone to remove the attachment. They are very crooked and have far to much power.

    I’ve asked for a new case worker and they said it is not possible. Next step write my MLA, Premier and the Prime Minister

    Is Family Maintenance Enforcement a Criminal Racket?

    There are increasing reports of payees not receiving their payments and other reports of long delays in payments which are automatically deducted at source.

    These are the telltale signs of internal corruption where money is diverted by managers into private money market portfolios where that money, you money, is used to gamble on stocks, hedge funds and everything else.

    There are suspicions that FMEP Directors are part of a government bureaucracy that is in league with the drug cartels.

    The provincial court judiciary are part of that mob which may explain why they always help FMEP.

        The best thing to do,

        It is to never tell them any of your personal information straight from the beginning. Unless, you have a court order stating that you to deal with this criminal entity (FMEP).

        As soon as I realized that they make statement which are not inline with the Family Law Act, I told them that they are no longer authorized to contact me and directed them to my lawyer, and told them that I do not wish to be enrolled with them (even if they are trying to tell me that I do not have a choice).

        This way, there’s nothing they should be able to do, unless they breached the Privacy Law Act, than if they do, I will sue them.

            Make sure you keep good notes on what the FMEP agent says as they will lie and miss lead you in thinking they are doing their job at the same time they will continue miss representing you. This is a service belongs in countries with no human rights.

    FMEP can only enforce the amount that is indicated in the court order or agreement. They cannot change what is on the agreement or court order. That is why they recommend to obtain new agreement or court order if there is any changes with the child support, spousal support and extra ordinary expenses. If there is any circumstances surrounding the payor like he or she is in the income assistance, lost job and any related problems with his or income they might consider it. But as long your case is enrolled in FMEP they will continue to enforce the amount owing and monthly maintenance and they will take enforcement action when necessary.

      bull shit. they often enforce things that are not on orders. So if a child moves from one parent to the other, every time the kid moves you need a new court order and no proof needed just the truthful words of the other party.They are all liars and they need to get cancer and go thru the pain that they cause people.Nothing but liars and scum bags.One scumbag stands out SINGH

    I recommend everyone that has an issue with FMEP to contact the governor general. Under the Family Maintenance Act sec. 49 she is the only one who can enforce against FMEP. She can dismiss the director and down the line. I have sent a letter to her and the more people that report to her will maybe get attention. FMEP is a criminal, destructive organization and the only person that can do anything is the governor general. They need to be dethroned and you people can help.

    I have never missed a payment for 25 years and still have to pay. I picked apart the review form they sent to the recipient and pointed out all the lies, the questioned not answered and it wasn’t even signed by the recipient. They are still going to steal our families money. I have also told them that I have been paying for 7 sevens for an adult we don’t even know and its time to stop so I can pay for my son’s schooling to become an engineer and they still say to bad we don’t care and shut up and pay. Bastards!!!!!

    I missed 2 payments due to a banking error, after paying religiously for years. I was 150.00 behind and the worker sent garnishment order to my employer and added a default fee…I requested it be removed, she blew me off. I then whatevered it, and carried on. Only a week later to receive garnishment orders to every financial establishment I have dealt with since I was 18. Literally dropping my credit over 200 points. In one shot. Then she immediately started retracting them all. Damage is done. I needed a temporary loan to manage christmas which her actions have now left me denied of. On top of the numerous fees I am now facing after she locked my bank account. I am a ft father to one and pt to 2 others. All over 150.00 dollars. They are criminals and that was a direct abuse of power on the workers part. I am disgusted that the government would condone these brutal inhuman acts of family terrorism. Because that’s what they are, terrorists…They only see their own nose on their face and that is all. I truly feel sorry for their kind.

    So why did fmep get all my taxes and hold them when I have no arrears owing and my child support is all caught up to date???? This is none sense you pay child support every month and caught up but still take my taxes…… and I don’t owe nothing…. now that’s just straight unfair for people who pay taxes pay child support and see my child….

      I would wrote to the BC attorney general. His name is Honourable David Eby and his email is at.minister@gov.bc.ca I was having issues with my case worker C.A. Zimmermann and a couple emails to him and it was all cleared up. Don’t waste your time on the FMEP employees/managers they are only there to screw you.

    So for the third time in two years family maintenance has Literally stolen an ENTIRE paycheck from me when I was COMPLETELY up to date on my payments. Week after week goes by waiting for them to send my money back that should NEVER have been taken to begin with.. THEIR ONLY JOB IS TO CHECK AND UPDATE WEATHER OR NOT PPL ARE UP TO DATE ON PAYMENTS AND THEY CAN”T EVEN DO THAT ONE THING plus are NOT supposed to take ENTIRE checks ever.. this whole program need some serious monitoring to keep heartaches like this from happening as it is financially and emotionally crushing.

    FMEP took over ten grand off what the payor owes and gave a bad reason for it. I don’t think they took the money off….I THINK they are frauding the system and keeping the ten grand for themselves. I want this investigated. How do I do that? The money doesn’t come in consistently and there have been gaps….it is those gaps that I believe money is coming in but whoever has my file is keeping that money for their own personal gain. I as well do not understand why in Canada we don’t have a system where the provinces are equal in this …. all provinces have different ways of handling the situation and it shouldn’t be like that. ONE system for all with FMEP across Canada to make life easier.
